一個晶片專利，就讓蘋果公司在地院判賠280億元！

這個威斯康辛大學校友研究會(WARF)擁有的專利，蘋果去舉發／撤銷，結果是不成立，而英特爾在走完訴訟準備程序後，發現沒得逃，就跟它和解了。

這兩家公司都夠大，不是一般的小公司，找的律師事務所也都是頂尖的，律師費都在一千萬美元以上，他們建議Intel和解的決定，不會亂給，Intel也不會亂下。真的是沒得逃了，才和解的。

這學校沒有先找小公司開刀練身體籌訴訟費，而是直接挑戰龍頭老大，沒有三兩三，不會上梁山。這專利一定夠強。

請求項 1. In a processor capable of executing program instructions in an execution order differing from their program order, the processor further having a data speculation circuit for detecting data dependence between instructions and detecting a mis-speculation where a data consuming instruction dependent for its data on a data producing instruction of earlier program order, is in fact executed before the data producing instruction, a data speculation decision circuit comprising:
a) a predictor receiving a mis-speculation indication from the data speculation circuit to produce a prediction associated with the particular data consuming instruction and based on the mis-speculation indication; and
b) a prediction threshold detector preventing data speculation for instructions having a prediction within a predetermined range.
